 The national trademark can be extended to foreign countries of interest through specific requests depending on whether the countries are part of the Madrid Agreement or Protocol.

In this case, the trademark will be valid for the Italian territory and for the foreign countries for which the registration has been extended.

For international trademarks, it is advisable to allow at least three months' grace period, as the priority arising from the filing of a national trademark must be valid if the Italian trademark office registers the national trademark within six months.

Filing an international trademark involves applying for multiple national trademarks through a single procedure.

At the end of the international stage which lasts approximately 12 months, the international registration is granted with its publication in the WIPO database. WIPO then transmits the files to the offices of each designated country and the national phases.


Before proceeding with registration, the trademark office of each country conducts prior art searches and only if there are no prior art trademarks or if it deems the trademark registrable under its jurisdiction, does it proceed with registration or reject the application, providing reasons are given.

You will then need to decide whether or not to contact our local representatives in the relevant country.

The national phase lasts on average 12/18 months.

Legal protection requires separate legal action for each country, with associated costs and time.

It is also required to use the trademark in each country to avoid losing exclusivity after the first 5 years of non-use.

By previously carrying out the search for Italian, Community, international, and United States trademarks, we have reasonable certainty that we can start the international application.

It is also possible to carry out searches for national trademarks in each country of interest in advance.

Costs vary from country to country. A cost-effectiveness assessment is necessary.

The cost/performance ratio remains focused on a high level of quality of service.

Post-deposit offices often send communications and requests that require an appropriate response.

These potential costs and the costs of pursuing any legal action are not included in the filing fees.
